Being charges with crimes relating to domestic violence requires a highly skilled defense team.  The criminal defense lawyers at Padway & Padway Law Offices effectively defend against domestic violence charges in Milwaukee and across the State of Wisconsin.  Domestic violence is aggressively prosecuted in the State of Wisconsin and these types of cases are challenging and unique.   Domestic violence is a charge modifier or enhancer typically associated with battery, disorderly conduct, criminal damage to property, trespass to a dwelling, and other charges resulting in injury to a family or household member, spouse, ex-spouse, current or former roommate, or someone with whom you share a child.  A closer look at some of the more common domestic violence terms below.

Domestic Abuse: defined as intentional infliction of physical pain, physical injury or illness; or intentional impairment of a physical condition; first, second, or third-degree sexual assault; or causing another person to fear that they will be subject to any of the above.

Prominent Aggressor: Law enforcement will focus on the degree of physical injuries; statements made by witnesses; history of domestic abuse between the parties; threats; extent of fear between parties; and other factors deemed appropriate.

Contact Prohibition: Unless waived, there will be a 72 hour no-contact put in place immediately following an arrest for a domestic abuse incident which requires that the arrested person avoid the residence of the alleged victim, any premises occupied by the alleged victim, and any contact whatsoever with the alleged victim.    If you violate this order, you could be subject to fine up to $10,000 and/or a jail term of up to 9 months.

Penalties: Domestic Abuse is an enhancer or modifier to a crime.  For instance, a battery is a class A misdemeanor.  When you add a domestic abuse enhancer, the penalties can increase significantly.
